What these terms cover

These Terms apply to the public Site — its pages, content, forms, and any materials we make available for download. They do not govern use of the Omnilytical platform itself. Access to the platform is provided only under a separate written agreement between C308 Marketing, Inc. and the customer, and that agreement controls in the event of any conflict with these Terms.

Intended use

The Site is intended for business use and for people evaluating our services on behalf of a business.

Permitted use

You may use the Site to learn about Omnilytical, request information or a demonstration, and contact us. You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Submit false, misleading, or another person's information through our forms
• Access or attempt to access any non-public area of the Site or our systems, or probe, scan, or test the vulnerability of the Site
• Use any automated means — bots, scrapers, crawlers — to access, copy, or monitor the Site or its content, other than search engines indexing public pages
• Interfere with the operation of the Site, or introduce malicious code
• Copy, reproduce, modify, distribute, or create derivative works from Site content except as expressly permitted below
• Remove or alter any copyright, trademark, or other proprietary notice on the Site

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms.

Ownership and intellectual property

The Site and everything on it — text, graphics, logos, designs, product descriptions, downloadable materials, and the software that runs the Site — are owned by C308 Marketing, Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Omnilytical™ and the Omnilytical logo are trademarks of C308 Marketing, Inc. c308 and the c308 logo are also trademarks of C308 Marketing, Inc. Other names and logos appearing on the Site are the property of their respective owners and are used for identification only; their appearance does not imply endorsement.

You may view, download, and print Site content for your own internal business evaluation of our services, provided you keep all proprietary notices intact. No other right or license is granted to you by these Terms or by your use of the Site.

Information you submit

When you submit information through the Site — a contact or demo request, for example — you represent that it is accurate and that you are authorized to provide it. We handle that information as described in our Privacy Policy. If you send us ideas, suggestions, or feedback about our products, you agree we may use them without restriction or compensation to you.

Communications

By providing your contact details through the Site, you agree that we may contact you about your inquiry and our services by email, and by phone if you have provided a phone number.

Third-party sites and content

The Site may link to third-party websites or include third-party content. We do not control and are not responsible for those sites or their content, products, or privacy practices. Links are provided for convenience and do not imply endorsement.

Disclaimers

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, error-free, or secure. Descriptions of our products and services on the Site are for general information and do not form part of any agreement for those services.

Limitation of liability

To the fullest extent permitted by law, C308 Marketing, Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, business, or profits, arising out of or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or related to the Site or these Terms will not exceed one hundred U.S. dollars ($100).

Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless C308 Marketing, Inc. and its officers, employees, and agents from any claim, loss, or expense, including reasonable attorneys' fees, arising out of your violation of these Terms or your misuse of the Site.

Governing law and venue

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Ada County, Idaho, and you consent to the personal jurisdiction of those courts.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

General

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site. If any provision of these Terms is found unenforceable, the remainder will continue in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
